This Chem Impex International, Inc. (together with its subsidiaries and affiliates — “Chem Impex,” “we,” or “us”) Privacy Policy (“Policy”) explains the types of personal information we collect, how we use and share it, and the rights and choices available to you.
This Policy applies to personal information we collect or process, including when you use our website and when you interact with us in person or through any direct contact channels (“Chem-Impex Services”).
By continuing to use Chem-Impex Services, you acknowledge this Privacy Policy and agree to our Site Terms and other important policies available on our homepage.
1. Updates to this Privacy Policy
We may update this Policy from time to time as our data practices or legal requirements evolve. When we make material changes, we will notify you and revise the “Last Revised” date at the top of this document. We encourage you to review this Policy periodically for updates when accessing our website.
2. Information We Collect
When you visit or use the Chem-Impex website or otherwise interact with us (for example, by phone or email), the following categories of personal information may be collected:
- Identifiers. Information that can be used to identify you, such as your first and last name, username, phone number, email address, postal address, and IP address.
- Professional or Employment Related Information. If you provide it, your business contact information, company name, job title, business address or billing address.
- Financial Information. Payment or billing details (e.g., credit or debit card data or other payment method details) if you make a purchase or payment through us.
- Commercial Information. Details about your business interactions with us, such as products ordered or quoted, order history, frequency of orders, promotions applied (e.g., discounts), marketing or communication preferences, and any items placed in “My Cart” (or requested for quote or reorder).
- Internet or Other Network or Device Activity Information. Information related to your use of our website or services, such as browsing or search history, pages viewed, time spent, referral or exit pages, and information about your device (e.g., device type, browser type and language, operating system version, unique device identifiers, and IP address).
- General Geolocation Information. Imprecise or approximate location data derived from your device or browser (for example, based on IP address), if applicable.
- Communications and Content Information. Any information you provide when contacting us via email, phone, or web forms, including any communications, messages, or files you send.
- Audio or Similar Information. Audio recordings or call metadata when you contact Customer Support or Sales via phone or other audio channel.
- Inferences / Profile Data. Inferences derived from the information above — for example, predictions about your likely interests, business needs, or ordering behavior.

Other Information. Any other information you voluntarily provide when communicating or interacting with us (for example, notes, metadata from email exchanges, or other free form data).
Depending on how you use the Chem Impex Services, we may also collect the following category of more sensitive information:
- Account Login Information. Login credentials such as usernames and passwords that permit access to your account, where applicable.
We may also aggregate or de identify the data described above. Aggregated or de identified data, that we do not attempt to re identify is not subject to this Policy.
Without this information, we may not be able to provide you with all the requested services.
3. Sources of Information
We obtain the personal information described in Section 2 from a variety of sources. Depending on how you interact with us, we may collect or receive information from one or more of the following:
- Directly from you. When you create an account, place orders, request quotes, communicate with us (phone, email, web form), enroll in the Chem-Circle Rewards Program (“Chem-Circle”), or provide information for billing, shipping, or business contact purposes.
- Automatically from your device or browser. When you visit our website or use our online services, information collected through cookies, analytics tools, server logs, and other similar technologies. For more information about cookies and how we use them, please read our Cookie Notice.
- From service providers or vendors we use. From third parties we work with to operate our business, such as payment processors, hosting providers, fraud prevention services, CRM platforms, and vendors that support analytics, email communications, or customer service.
- From publicly available sources or business registries. Such as business directories, business registries, or other publicly available professional information, primarily to verify company details or professional status.
- From third parties or referrals (when applicable). From business partners, suppliers, or others who may refer you to us or provide your contact information with your consent.
- Other sources (if voluntarily provided). Information you voluntarily submit through uploaded documents, attachments, or other user-initiated submissions.
We may combine or link information collected from different sources to deliver services, fulfill orders, or comply with legal and business obligations.
4. How We Use Your Information
We use the personal information we collect for the business and commercial purposes described below. These purposes help operate the Chem Impex Services, deliver products and services, support ongoing customer relationships, and comply with legal and regulatory requirements.
A. To Provide Services and Fulfill Transactions
We use your information to operate our services and complete the transactions you request. Examples include:
- Process and complete orders, payments, billing, shipping, and order history.
- Maintain and manage your account by verifying identity, securing login credentials, and enabling account related functions.
- Administer the Chem-Circle loyalty program (tracking points, reward redemption, loyalty status benefits, and related perks).
- Process quote requests and manage business pricing, reorder requests, or custom quotes.
- Operate and maintain the website and e-commerce systems to support core business functions, ensure secure transactions, provide a smooth customer experience, and address technical issues.
B. To Communicate With You
We use your information to communicate with you about your accounts, our services, and your requests. Examples include:
- Provide customer service, technical support, and respond to inquiries by phone, email, or web chat.
- Send updates about orders, account activity, products, services, and any regulatory or safety notices related to your purchases.
- Send loyalty program notifications, reward updates, and personalized offers through Chem-Circle.
- Respect your communication and marketing preferences, including subscription choices and opt-in or opt-out selections.
C. For Improvement, Quality Assurance and Security
We use your information to monitor, analyze, and improve our services and ensure their security. Examples include:
- Analyze ordering patterns, customer interactions, and service usage to improve products, services, and overall customer experience.

D. For Legal, Compliance and Administrative Purposes

5. How We Disclose Your Information
We may disclose your personal information to the categories of third parties described below as needed to fulfill the business, operational, commercial, or legal purposes described in this Policy — and as permitted or required by applicable law.
A. To Chem-Impex Affiliates and Subsidiaries (Internal Sharing)
We may share your data between and among Chem Impex International, Inc., its subsidiaries, and affiliates — including our back office support teams (which may be located outside North America). We do this to administer programs (such as Chem-Circle), process orders or quotes, support customer service, manage accounts, and perform other internal business operations.
B. To Service Providers and Vendors
We share the personal information described in Section 2 with trusted third party service providers who perform services on our behalf. These services may include, for example:
- Payment processing and order fulfillment;
- Website and data hosting, infrastructure maintenance, security, and performance monitoring;
- Customer service, support, and CRM systems;
- Fraud prevention and identity verification;
- Analytics, marketing support, and promotional services;
- Professional services such as auditing, consulting, legal or compliance advice;
- Other services required to operate and maintain Chem Impex Services.
These providers are only permitted to use your information to deliver the services on our behalf — not for their own independent purposes — under agreements that require confidentiality and compliance with applicable data protection regulations.
C. To Business Partners, Distributors, or Licensees
If you obtain products or services through third party business partners, distributors, or licensees with whom we collaborate, we may share your information with those partners as necessary to fulfill orders, coordinate supply chain logistics, or enable distribution and delivery. Please note that these partners have their own privacy practices.
D. Advertising, Marketing, and Analytics Providers
We may share certain categories of information (excluding sensitive personal information, unless otherwise disclosed) with advertising, marketing, or analytics service providers. This helps us deliver relevant promotions, analyze traffic and user engagement, and provide targeted advertising, offers, or loyalty program program communications.
E. For Corporate Transactions
If Chem-Impex is involved in a merger, acquisition, sale of assets, financing, or similar corporate transaction, your personal information may be shared with prospective or actual buyers, investors, or other involved parties — as part of due diligence or transfer of business assets. In such cases we will require the receiving entity to honor the commitments made in this Privacy Policy, or we will notify you of material changes.
F. Legal, Regulatory, and Safety Related Related Disclosures
We may disclose your information when required or permitted by law, regulation, subpoena, court order, or other legal process. We may also do so to enforce our terms and policies, protect the rights, property, or safety of Chem-Impex, you, or others, or to defend against fraud or other wrongdoing.
G. With Your Direction or Consent
We may share your personal information with others if you instruct us or provide explicit consent to do so.
H. Publicly Released Released or Public Content
If you choose to submit information for public display (for example in product reviews, public commentary, or shared content), that submission is considered public — and we are not responsible for how others use or share that information.
6. How We Protect Your Information
We use reasonable technical, physical, and administrative security measures to reduce the risk of loss, misuse, unauthorized access, disclosure, or alteration of your information. However, because no security system is infallible and because use of the Internet inherently carries risk, we cannot guarantee that personal information will always be safe from intrusion or unauthorized access. You are responsible for safeguarding your passwords and maintaining the security of your devices and accounts.
7. Retention
We store personal information only as long as is reasonably necessary to fulfill the purposes described in this Policy — for example, to provide services to you, maintain our business records, resolve disputes, and comply with legal or regulatory obligations (such as record keeping requirements). Once your information is no longer needed for any of these purposes, we will either securely delete it or irreversibly anonymize it, in accordance with applicable law.
8. Cross-Border Transfers
The personal information that you provide us is stored and processed on servers owned by Chem-Impex and other companies in the United States, Canada or elsewhere around the world, including locations outside of the country or jurisdiction where you are located. Regardless of the company or person who processes your information and where it is processed, we will take steps to transfer and protect your information through appropriate safeguards in accordance with applicable data protection laws and this Policy. 9. Children’s Privacy
We do not intend for our websites or online services to be used by, and do not knowingly collect information from, anyone under the age of 18, or the relevant minimum age under applicable local law. Additionally, we do not knowingly sell or share information of our customers under the age of 18 for targeted advertising. If we learn that we have received information directly from a child, we will take appropriate action in accordance with applicable law.
10. Third-Party Sites
Our website may offer links to websites that are operated by third parties and not by Chem-Impex. If you visit one of these linked websites, you should read the website’s privacy policy, terms and conditions, and other policies. We are not responsible for the policies and practices of third parties. Any information you give to those organizations is governed under their privacy policy, terms and conditions, and other policies.
11. Your Privacy Choices and Rights
You have control over the personal information you share with Chem-Impex. This section explains the choices and rights available to you. When you submit a request, we will follow applicable laws and verify your identity to keep your information safe. Exercising your rights will not affect your access to Chem-Impex Services or how we treat you.
A. Your Choices
When you interact with Chem-Impex Services (for example, via our website, by phone, or email), you have the following options regarding your personal information:
- Access Your Personal Information. Request a copy of the personal information we hold about you, including what we collect, how we use it, and who we may share it with. We verify your identity before responding to ensure your information stays secure.
- Update Your Personal Information. Request updates or corrections to your personal information. Some updates can be made directly in your account profile. For other updates, contact Customer Service. Historical or backup records may still be retained as allowed by law.
- Delete Your Personal Information. Request that we delete the personal information we have collected about you. Certain information may need to be retained for legal, regulatory, or operational purposes. Identity verification is required before processing deletion requests.
- Opt-Out of Selling or Targeted Advertising. While we do not sell personal information for money, we may share certain information with advertising or analytics partners for targeted marketing. You can manage your preferences through the Cookie Preferences or the Do Not Sell or Share My Personal Information links at the bottom of the website. You may need to reapply preferences if you change devices, browsers, or clear cookies. Global Privacy Control (“GPC”) signals are recognized as valid opt-out requests where required by applicable privacy law.
- Opt-Out of Promotional Emails. You can unsubscribe from marketing emails (newsletters, promotions, surveys, or offers) at any time using the link provided in the email. Non-promotional emails, such as order confirmations or account updates, cannot be opted out of.
- Opt-Out of Promotional Mail. If you prefer not to receive physical marketing materials (such as journals, postcards, or other promotional items), contact Customer Service. Some items may still arrive if mailings were processed prior to your request.

Opt-Out of Text Messages. You may consent to receiving automated text messages. You may opt-out of receiving automated text messages at any time by texting STOP to any text messages you receive. Note that when you opt-out of receiving automated marketing text messages you may still receive promotional emails, please see our Mobile Terms of Service.
B. Your Privacy Rights in the U.S. and Canada
You may submit a request to exercise the rights described below. We will respond to your request consistent with applicable law, including applicable exceptions.
- Right to Know and Access (Data Portability). You may have the right to (1) know what personal information Chem-Impex processes about you, including the categories of personal information, the categories of sources from which it is collected, the business or commercial purposes for collecting, selling, or sharing it, the categories of third parties to whom we may disclose it, including a specific list of third parties to whom we have disclosed our customers’ personal information; and (2) receive a copy of the specific personal information we have processed or are processing about you.
- Deletion. You may have the right to request that we delete information that we collected from you and retained, subject to certain exceptions.
- Correct Inaccurate Information. You may have the right to request that we correct inaccuracies in the personal information we maintain about you.
- Opt-Out of Sale or Sharing (Targeted Advertising). Although we do not sell your personal information for money, our sharing of your personal information with some advertising partners (including certain identifiers, internet or other network or device activity information, and inferences about your use of Chem-Impex Services) may be deemed a “sale” or “sharing” for targeted advertising purposes under applicable privacy laws. You may have the right to opt-out of your personal information being sold or shared for purposes of targeted advertising. You may exercise this right with respect to such selling or sharing that takes place via cookies and similar technologies on this website by managing your preferences using the Cookie Preferences link at the bottom of the website. (You may need to repeat the Cookies Preference selections from each device and browser that you use in connection with Chem-Impex Services, as well as in a particular browser or device if you clear cookies or reset the browser.) Some web browsers allow customers to automatically exercise their right to opt-out of sale/sharing with all businesses they interact with online through that web browser by initiating an opt-out preference signal. We will honor such opt-out preference signals. To opt out of the sale or sharing of personal information for targeted advertising that does not take place via cookies or similar technologies on this website, please submit an opt-out request using the “Do Not Sell or Share My Personal Information” link.
- Limit Use of Sensitive Information. We do not collect, process or disclose sensitive personal information for the purpose of inferring characteristics about you or for any purpose other than when permitted under applicable law. As such, we are not required to provide a “Limit the Use and Disclosure of My Sensitive Personal Information” link.

Appeals. You may appeal our decision with respect to a request you have submitted by contacting us as described in Section 14 below.
Requests should be submitted to customer@chemimpex.com. Once we receive your request, we may verify it by requesting information to confirm your identity. We reserve the right to deny your request if we cannot verify your identity or if an exception applies under applicable law.
C. Additional California Rights
If you are a California resident, you can also request a notice disclosing the categories of personal information we have shared with third-parties for the third-parties’ direct marketing purposes. To request a notice, please submit your request to customer@chemimpex.com.
12. Notice of Financial Incentives and Chem-Circle
Chem-Circle is our way of thanking and rewarding loyal customers for engaging with Chem-Impex and purchasing our products online. Customers join Chem-Circle by opting in and can earn benefits such as points, or special offers, see the Chem-Circle Terms of Use.
To operate Chem-Circle, we collect and use the types of personal information described in Section 2, including information you voluntarily provide (such as your name, email, and business contact information), information collected automatically through our services, and information from other sources. This information allows us to administer your rewards account, track points or other benefits, and provide personalized offers or communications.
We work with third-parties to provide the benefits of Chem-Circle. These may include Chem-Impex subsidiaries and affiliates, service providers, and business partners. For more details on how we share your information, see Section 5.
Chem-Impex does not assign monetary value to the personal information we collect through the Chem-Circle loyalty program for the purpose of sending email communications. You can opt-out of receiving promotional emails at any time by clicking the “unsubscribe” link in any promotional email we send.
Participation in Chem-Circle is voluntary. You may withdraw from the program at any time by emailing customer@chemimpex.com. Please note that if you withdraw, any points or rewards you have accumulated up to that point will be forfeited.
As explained above, we use your personal information to provide communications and services through Chem-Circle. If you request deletion of your personal information from the program, we will no longer be able to provide you with services or benefits under Chem-Circle.
Based on our reasonable and good faith estimate, we receive value from Chem-Circle in increased customer loyalty and patronage, though any value will vary by Chem-Circle member depending on purchases made, offers a member takes advantage of, and many other factors.
13. Additional Disclosures for Data Subjects in the EEA, the U.K. and Switzerland
This section provides general information about how Chem-Impex collects, stores, uses, transfers and otherwise processes personal data in or from certain countries in the European Economic Area, the United Kingdom, and Switzerland (together, for purposes of this section of this Policy, “EEA”), in accordance with the General Data Protection Regulation (GDPR) and its local implementations.
A. Lawful Bases for Processing
When Chem-Impex acts as a data controller and determines the purposes and means of processing your personal data, we process your data only on a lawful basis. These lawful bases include:
- Contractual necessity: to fulfill orders, provide products or services, manage accounts, or operate programs such as Chem-Circle. Examples include: (i) processing your purchases or service requests and (ii) communicating with you about orders, returns, services, accounts, programs, contests, or promotions.
- Legitimate business interests: to operate, maintain, and improve our services, prevent fraud, or protect security. Examples include: (i) responding to customer inquiries, (ii) maintaining and analyzing our websites, apps, and other services, and (iii) detecting or investigating security incidents or fraudulent activity.
- Legal obligations: to comply with applicable law or regulatory requirements. Examples include: (i) maintaining appropriate records for administrative purposes and (ii) providing product safety information or notices, including recalls.

Consent: when you explicitly opt in, such as to receive marketing communications or special offers. You may withdraw consent at any time by updating your promotional preferences or contacting us as described in Section 14.
B. Your EEA Data Subject Rights
Depending on your location and circumstances, you may have the right to:
- Request access to your personal data.
- Request correction of inaccurate or incomplete data.
- Request deletion of personal data, where no legal or operational reason exists to retain it.
- Object to processing based on legitimate interests or for direct marketing purposes.
- Request restriction of processing.
- Request transfer of personal data to another party, where technically feasible.
- Not be subject to automated decision-making that produces legal or similarly significant effects (we do not engage in this practice).
To exercise your rights, see Section 11 or contact us as described in Section 14. We will verify your identity before processing requests and respond within 30 days.
C. Retention
We retain personal data only as long as necessary to fulfill the purposes for which it was collected or as required by law. In some cases, we may retain data longer to honor opt-out requests, comply with legal obligations, or maintain records for accounting or regulatory purposes.
D. Transfers Outside the EEA
Your personal data may be transferred to and processed in countries outside the EEA, including the United States, Canada or India. We ensure appropriate safeguards are in place to maintain an adequate level of protection for your data in accordance with applicable laws, such as standard contractual clauses.
